1. Introduction

This document establishes the General Conditions of Sale that apply to all non-professional customers (hereinafter "Customer" or "Customers") wishing to purchase products through the website www.deco.cin.com (hereinafter "CGVonline").

Please read these general conditions of sale carefully. When using this site or placing an order through it, the Customer is aware that they must comply with these conditions in full. Therefore, if the Customer does not agree with all the conditions, they should not use this site.

These conditions may be amended without prior notice. The conditions applicable are those in force when entering into contract.

2. Our details

This website is run under the name CIN by CIN-CORPORAÇÃO INDUSTRIAL DO NORTE, S.A., a public limited company, with headquarters at Avenida de Dom Mendo, 831 4474-009 Maia, Portugal, registered at the Commercial Registry of Maia with tax and commercial registration number 500.076.936, with share capital of EUR 25,000,000.00 (twenty five million euros).

3. Your details and your visits to this web pages

The information or data provided by Customers will be treated in accordance with the provisions of CIN's Privacy Policy. By using this website, the Customer consents to such information and data being processed, and declares that all the information or data provided is true and corresponds to reality.

4. Use of our webpage

By placing orders through our website, the Customer commits to:

  1. Using this page for legal enquiries or orders only – if the order can be found not to be for legal purposes, CIN is authorized to cancel it and inform the relevant authorities.
  2. Providing the relevant data to carry out the order in a true and accurate manner, authorising its processing.
  3. Declaring and proving, whenever necessary, legal age and/or that he/she has the legal capacity to enter into contracts.

5. Service availability

The items presented in this website are available for delivery during working days at CIN stores.

6. Entry into contract

To place an order, the Customer must follow the purchase procedure established in this webpage, starting with the acceptance of these CGVonline and ending with a click in "Authorize Payment".

This procedure constitutes a contract of sale with CIN (the "Contract").

Subsequently, the Customer will receive an email to the address identified during the purchase process, to acknowledge receipt of the order ("CIN - Order Confirmation”) and another to confirm shipment ("CIN - Shipment Confirmation)”.

7. Product availability

All product orders are subject to availability.

If a timely delivery cannot be achieved, information on unavailability will be sent to the Customer within 5 (five) days of acknowledgement. The reimbursement of amounts already paid for unavailable products will occur within a maximum of 30 (thirty) days.

8. Delivery

Without prejudice to the provisions in Clause 7 above regarding the availability of products, and unless extraordinary circumstances occur, CIN will try to send the confirmed order within a maximum period of 30 (thirty) days from the date of the order.

However, delays or impossibility may occur due to unforeseen circumstances or events beyond the control of CIN and the contracted shipping services (Force Majeure Events).

In both cases, the Customer will be sent information of the circumstances in question and will be given the option to continue with the purchase, setting a new delivery date, or cancel the order with a full refund of the amount already paid.

The ordered products can also be picked up at a CIN store chosen by the Customer during the purchase process, as long as it is available in a list of stores available for this purpose, and at no additional cost.

In this case, an e-mail will be issued when the order is ready for pickup.

Anyone who comes to the store to collect the products purchased online must show proof of identity and display an order number or message confirming the order is ready for pick up. Without these elements, CIN will not deliver the products.

In any case, the order is considered fulfilled with the signature of receipt on the delivery receipt to the address indicated.

9. Impossibility of delivery

If it is impossible to deliver the order to the address given by the Customer, a note will be left indicating where it is and what to do to have it redelivered. If the Customer is not at the place of delivery on the agreed date, he/she will be asked to contact CIN so that the delivery can be rescheduled.

If a delivery cannot be made on the second attempt, the Customer will be charged shipping costs again for each delivery attempt.

10. Product ownership and risk transfer

The Customer shall acquire ownership of the products at the time of delivery in accordance with the definition in Clause 8 and the risks of the products shall be borne by him/her from that moment onwards.

11. Price and payment

The price of each product will be what is indicated, at each moment, in this web page.

During the order process, the Customer will find at their disposal the accepted payment options and can choose which one best suits their interests.

12. Value added tax

All purchases made through this website are subject to the Portuguese Value Added Tax (VAT) rate in force.

13. Right to terminate contract

According to the applicable regulations, the Customer has the legally established right to terminate the contract within 14 days from the date of delivery of the products.

To exercise this right, the Customer must contact CIN using the contact form or telephone numbers indicated in the website, unambiguously informing of their decision to terminate the contract.

CIN will send in writing, to the e-mail address provided during the purchase process, information on how to return the purchased products.

CIN will refund the amount paid for the products through the same form of payment that the Customer used in the original transaction, less the costs of delivery and return.

Reimbursement will only be made after receiving the products, which must be returned in the same conditions in which the Customer received them, there being no reimbursement if the product has been used, opened or suffered any kind of damage, including damage to the packaging.

Thus, after receiving and examining the products, CIN will inform the Customer whether they are entitled to a refund of the amounts paid.

The right to contract termination shall not apply, and there shall be no returns or refunds, in respect of products manufactured at the Customer's request and in accordance with their specifications, including in this case those products whose colours are prepared with the automatic colour matching system.

14. Faulty products

In cases where, at the time of delivery, the product is not in accordance with the provisions of the contract or is defective, the Customer must indicate this in the shipping document and contact CIN within 5 working days after receipt of the product, making a formal complaint using the form available on the site, indicating the details of the product and defects. CIN will then communicate how to proceed.

In situations where the defect is revealed at the time of use of the product or after its application, the Customer must communicate the fact to CIN within 30 days of the knowledge or occurrence of the defect, submitting a formal complaint using the form available on the site, indicating the details of the product and defects. CIN will then communicate how to proceed.

15. Processing personal data

This website and CIN’s online sales policy are in compliance with all applicable EU and national legal regulations on data protection, privacy and security of the Customer’s personal information, in accordance with the terms of the Privacy Policy which is accessible at www.deco.cin.com.

CIN collects and processes personal data exclusively for the purpose of using, registering and managing the purchases made and for the purpose of communicating products and services made available by CIN, the legitimacy of the processing of personal data being based, as the case may be, on the contractual relationship, data subject consent or the pursuit of legitimate interests.

Personal data processed in the context of CIN online sales will be kept for the period necessary to carry out the purposes of processing, in compliance with the legal deadlines in force, and Customers may at any time request the withdrawal of consent, opposition or limitation of processing, deletion or any other right to data protection.

The Customers’ personal data are processed exclusively by CIN, and there is no communication of data to third parties.

CIN facilitates the exercise of the rights of Customers who use CIN's web site for online sales regarding the protection of personal data. In addition to always being able to submit a complaint to the relevant supervisory authority, for any information or to exercise any kind of data protection rights, including rights of information, access, amendment, opposition, limitation of processing or deletion, data subjects may contact the CIN Data Protection Officer via e-mail to dpo_privacy@cin.com, describing the request and providing an e-mail address, a telephone contact or a postal address for reply.

16. Intellectual property

The Customer acknowledges and consents that all copyrights, trademarks and other intellectual property rights in the materials or contents that are provided as part of the website are, at any time, the property of CIN and may only be used if expressly authorised.

17. Written communication

The applicable legislation requires that part of the information or notifications sent by CIN must be in writing. By using this website, the Customer accepts that notifications with CIN are made electronically. Thus, CIN will contact the Customer by e-mail, to the address indicated during the purchase process, or will provide information with notices placed in this website. For contractual purposes, the Customer agrees to use this means of electronic communication and acknowledges that all contracts, notices, information and other notices sent electronically satisfy the legal requirement that such notices be in writing. This condition shall not affect the rights recognised by law.

18. Notices

Notices from the Customer should preferably be sent via the contact form on the website. In accordance with the provisions of Clause 17 above and unless otherwise stated, CIN will send notices to the customer by e-mail, to the address indicated during the purchase process.

Notices will be deemed to have been received and correctly made, at the same time as the Customer enters our website or 24 hours after an e-mail is sent.

19. Waiver rights

Failure on our part to demand strict performance by the Customer of any of their obligations under a Contract or these Conditions, or failure on our part to exercise any rights or actions which are due under such Contract or Conditions, shall not mean a waiver or any limitation in respect of those rights or actions, nor shall it relieve the Customer of their obligations.

20. Partial annulment

If any of these Conditions or any provision of a Contract is declared null and void, the remaining terms and conditions shall remain in force without being affected by such declaration of invalidity.

21. Sole agreement

These Conditions and all documents to which express references are made constitute the entire agreement existing between CIN and the Customer, in relation to the object of the Contract, and replace any other pact, agreement or promise previously established, verbally or in writing, in relation to the same matter.

22. Applicable laws and jurisdiction

The use of the CIN website and the purchase contracts made through such website are governed by Portuguese law.

23. Alternative dispute resolution

In case of dispute, Consumer may resort to one of the following Alternative Resolution of Consumer Disputes Entities: Centros de Informação e Arbitragem de Conflitos de Consumo do Vale do Ave; Vale do Cávado; Porto; Coimbra; Lisboa; Algarve or Nacional (email geral@cniacc.pt) whose contacts are available at www.consumidor.pt or at www.cniacc.pt or by calling +351 213 564 650.

 

Should any discrepancy or doubt occur between the Portuguese and the translated versions of this document, the Portuguese version shall prevail.
